Sirius XM Sues Former Programmer Who Jumped Ship For Spotify

THE MOUTH, JANUARY 26TH, 2016 –– Sirius XM Radio Inc. has sued its former country programmer, John Marks, in New York state court for jumping 7ship to rival Spotify USA Inc.. According to law360.com, it alleges that Marks violated a non-compete agreement and is using Sirius XM’s internal data against it. In a lawsuit filed last Thursday in New York Supreme Court in Manhattan, Sirius XM said that Mark E. Sebastian, known as John Marks, broke an agreement barring him from working at a competitor for one year.

Last November (11/1), Jockline reported that Mark's hire by Spotify was a move to bolster the music streaming outlet's country music presence. During his tenure at Sirius, Marks had earned a reputation for spotting talent and breaking young artists.

The East Coast Digs Out In The Aftermath Of Jonas

THE MOUTH, JANUARY 25TH, 2016 –– Following numerous deaths, millions losing power, hundreds of auto crashes and travel bans, the east coast is slowly digging out from this weekend's crippling winter storm Jonas. According to weather.com, the snow dropped 26.8 inches in Central Park, the second-most recorded since 1869. The storm dropped snow from the Gulf Coast to New England, with areas of Washington surpassing 30 inches. A rural area of West Virginia reported nearly 40 inches.

As usual, radio did its part in keeping listeners informed around the clock as some staffers holed up in nearby hotels and perhaps a cot or two at their stations. Some of our friends and associates in the region hit hardest shared a few close-ups. Phil Boyce, SVP/Spoken Word Format for Salem Media Group and Salem Radio Network told us he was hit with about 20 inches of snow at his home in NW New Jersey, but said 'The blessing for NYC was that this hit on Friday night." Phil Boyce and Lee Harris will be among the featured guests at this year's TSBC 7 in sunny Ft. Lauderdale on March 4&5.

Real-Life Drama Unfolding In Battle Over Radio Producer's Fortune

THE MOUTH, JANUARY 25TH, 2016 –– A real-life drama is developing following a lawsuit, which claims Himan Brown, the late creator of such classic radio dramas as "Dick Tracy" and "The Adventures of the Thin Man," was duped into putting the bulk of his $100 million fortune into a charitable trust controlled by his lawyer.

According to abcnews.com, Brown, a radio producer who died in New York City in 2010 at the age of 99, had wanted the money go to an organization he founded to promote radio theater, according to court papers. It claims attorney Richard L. Kay exploited Brown, who was 94 when he signed documents now being contested in Manhattan surrogate's court. It says Kay used the trust "for his personal benefit, in disregard of the express intent of Mr. Brown's will and prior estate plan."

The lawsuit was filed by Radio Drama Network, Inc., a private foundation started by Brown in 1984 to foster his love and appreciation for the radio serials that popularized the airwaves in the 1930s and 1940s. Several members of his family serve on its board of directors. Kay's attorney, Michael B. Kramer, disputes this account and said the lawsuit is the latest in a series of court challenges by members of the Brown family over the fortune. He insisted Brown was mentally sharp in October 2004 when he signed papers for the newly created Himan Brown Charitable Trust. The lawsuit, which was filed in December and made public last week, is next scheduled for a March 1 court date, but it could be years before it goes to trial. Brown produced more than 30,000 radio shows in a career that spanned from the 1930s into the 1980s and secured the radio rights to such characters as Dick Tracy, Flash Gordon and the Thin Man.
