Sirius XM CEO Says They'll Appeal Turtle's Lawsuit Ruling

THE MOUTH, OCTOBER 2ND, 2014 –– Sirius XM plans to appeal a federal-court decision that found it had violated California's copyright law by playing Turtles songs, according to the Wall Street Journal. In a transcript of Sirius XM CFO, David Frear's remarks during a Finance Conference, he said: "We intend to appeal the decision all the way through the appeal process." The Turtles' two founding members, Howard Kaylan and Mark Volman (R), who later adopted the name of Flo and Eddie, filed the lawsuit last year because Sirius XM, among other digital music services, has never paid performance royalties on songs recorded before 1972. In a summary judgment issued last week, it found that Sirius XM had performed the group's songs in California without permission and in doing so had violated state law. Frear said that the ruling implied that "every AM/FM station, bar, restaurant, stadium, Internet webcast or satellite guy has been operating in violation of California law since 1982. Not one case brought by one act ever. By that logic," he said, "the Rolling Stones, the Beatles, Joni Mitchell, Creedence Clearwater Revival and Frank Sinatra have all been "neglectful in protecting their own economic interests." Frear added that they were "happy to pay" for pre-1972 recordings, but only if its competitors are forced to pay under federal law as well. The Turtles have similar cases pending against Sirius XM pending in New York and Florida.

Chaz & AJ Help Replace Stolen Cash Going To Kid's Charity

THE MOUTH, OCTOBER 2ND, 2014 –– After news broke in Connecticut earlier this week of a man breaking into a brewery and stealing a jar of cash going to a local kid's charity, morning hosts Chaz and AJ (L) reached out to their listeners and helped raise over $2,500. On Wednesday's show he told listeners through a statement read by his radio partner Rick Lewis (R) that he is suffering from medical issues. “I feel like I’m ready to talk about this and feel like you deserve to know,” he said in his statement. “As you know if you’ve listened to the show at all for the past 24 years, I’ve struggled with certain medical issues. I’ve openly talked about it on the radio and I’ve made many jokes about my own medical issues that have plagued me for many years .. Some of you may know that with these types of conditions doctors will experiment with different kinds of drugs to see what will work. Some work for a while, some don’t work at all, and others can actually make things worse. This past year has been the biggest battle of my life as I continue to seek relief. Unfortunately I will not be coming back as I have to focus all my energy on my health and well being.” Floorwax also dismissed rumors that had been floating around that he was struggling with substance abuse. “I did not fall off the wagon,” he said. “I have been clean and sober for 30 years and am proud of that.” He also wanted to make clear that his employer, iHeartMedia, didn’t fire him. Slacker Returns To The Air After Health Scare

THE MOUTH, OCTOBER 1ST, 2014 –– As a follow-up to last week's lead story on KALC/Denver's afternoon co-host, Slacker (shown left with his co-host Steve), blacking out while on the air and being rushed to the hospital, we were pleased to learn yesterday that he was able to return to his "Slacker and Steve Afternoon Show." After undergoing numerous tests at the hospital, he was able to go home and even call into the show with an update last Friday (JD 9/29). During his call-in, his radio partner Steve said "We were scared, obviously," but Slacker joked "I was way more scared on the drive to the hospital in your car." As reported by Denver's 9 TV News, last Thursday, listeners heard a loud "thump" and then music began playing. Host Lil D later went on air to confirm that Slacker did lose consciousness during the broadcast. "I just remember taking a phone call, I'm fuzzy on a couple of details leading up to it," Slacker said when describing the incident. "Next thing I knew, Steve, you're over me, you're holding my head in your hands and I'm like 'how did I get here?'" Slacker said Friday that he's undergoing tests to determine what caused him to pass out, but that he's thankful for the public support.

He was supposed to perform five or six songs but ended up doing many more than that.
