BLOG: 'At Long Last' FCC Announces Its Plan To Modernize Broadcast Ownership THE MOUTH, OCTOBER 30TH, 2017 – In a blog penned by Jerianne Timmerman, SVP/Senior Deputy General Counsel at National Association of Broadcasters titled: Modernizing the Mother of All Media Regulations she points to The Federal Communications Commission (FCC) at long last announcing its intention to reform its woefully outdated broadcast ownership rules. At its open meeting in November, the FCC plans to vote on an order eliminating the ban on owning a print newspaper and any radio or TV station in the same market; removing the restrictions on owning radio stations along with a TV station in the same market; revising the rule that very strictly limits the ownership of TV stations in local markets; and reversing its previous decision effectively banning the joint sale of even modest amounts of advertising time by two same-market TV stations. Clearly, not every long-standing FCC rule should be eliminated or modified just because of its age. But the broadcast ownership rules fail to reflect today’s digital media marketplace, and the FCC’s past failures to update its rules flew in the face of Congress’ directive that the Commission must every four years determine whether its rules remain “necessary in the public interest as the result of competition” and “repeal or modify” those that are not. NETWORKS: CBS News Radio Unveils New Shows During Upfront Event THE MOUTH, OCTOBER 30TH, 2017 –– CBS News Radio is getting a new slate of programming for its more than 600 affiliates nationwide reports Adweek. Last week's upfront event, co-hosted with Skyview Networks, was joined by Jane Pauley, Jim Axelrod,Erin Moriarty, Lara Logan and Jill Schlesinger. Starting Jan. 1, the new additions to the CBS News Radio lineup will include: Daily, one-minute, self-contained news, lifestyle & entertainment and information updates from the CBS Television distribution shows including Entertainment Tonight, Inside Edition, The Doctors, Dr. Phil and Rachel Ray and Jill On Money, hosted by business analyst Jill Schlesinger will a two-hour weekend program along with daily, one-minute updates on breaking financial news and money tips. John DePetro Announces New Radio Home On WNRI A/M After Exit From WADK-AM Newport THE MOUTH, OCTOBER 30TH, 2017 –– Longtime New England host John DePetro said on Friday that he has left WADK-AM in Newport and would be making a “major announcement” (today) about where he was headed next, reports The Providence Journal. “I’ll be on the radio Monday,” DePetro said, “just not there.” As promised, DePetro announced this morning that his show, which has aired for the past few months in syndicated form in afternoons and weeknights on WNRI/Rhode Island & Massachusetts will now be heard "Live and Local" weekdays from 11:AM to 2:PM on AM/FM combo. DePetro, a former host on WPRO-AM/Providence for 10 years, had been on the air at the Newport station since January. DePetro said he would make the announcement on his website, depetro.com, and on social media at about 8 a.m (today). At WPRO, he was twice cited as talk show of the year by the Associated Press. But in 2013 an organization called 'For Our Daughters,' backed by organized labor, organized a boycott against him after he referred to protesters as “union hags.” He was off the air during that controversy for five weeks.

FCC To Vote Against 'Outdated Rule' To Keep Media Diversity In Local Markets THE MOUTH, OCTOBER 27TH, 2017 –– In FCC Chairman Ajit Pai's (TR) ongoing efforts to update media regulations, he announced this week that the commission will vote next month to eliminate a decades-old rule designed to preserve media diversity in local markets. The Washington Post says the move is aimed at supporting economically struggling media outlets in an age of digital consumption. But critics argue it will lead to greater media consolidation and the loss of independent voices. “The marketplace is nothing like it was in 1975,” Pai told lawmakers on Wednesday, arguing that the restriction on newspaper/broadcast cross-ownership was outdated. Pointing to the massive online media industry — and the enormous advertising revenue of companies such as Facebook and Google — Pai described the FCC's media ownership rules as a form of government intervention into a major civic institution. FCC Commissioner Mignon Clyburn (TL) responded saying, “The already consolidated broadcast media market will become even more so, offering little to no discernible benefits to consumers,” Pai's announcement came a day after the FCC voted to eliminate a 77-year-old rule requiring that TV and radio stations operate a physical studio in the areas where they're licensed. SiriusXM Defeats Turtles In Florida Court THE MOUTH, OCTOBER 27TH, 2017 –– The Florida Supreme Court on Thursday ruled against Flo & Eddie Inc., a company created by the singers, finding Florida common law does not recognize an exclusive right of public performance in pre-1972 sound recordings, reports Daily Business Review. “Flo & Eddie asks this court to recognize an unworkable common law right in pre-1972 sound recordings that is broader than any right ever previously recognized in any sound recording,” Justice Charles Canady wrote in a unanimous opinion. “Doing so would require this court to, among other things, ignore the lengthy and well-documented history of this topic — something we decline to do.” SiriusXM previously settled with Flo & Eddie, which filed class actions in Florida, New York and California on behalf of owners of pre-1972 sound recordings. The settlement, approved by a California federal judge in May, cost Sirius XM at least $25 million in payments to the class as well as a 10-year license. But the value of the settlement would have been higher if the Florida Supreme Court had ruled in favor of Flo & Eddie. READ STORY HERE
