CBS Prevails In Lawsuit Over Pre-1972 Songs

Ruling Could Help 'Immunize' Terrestrial Radio Operators And Others From Lawsuits

7THE MOUTH, JUNE 2ND, 2016 –– Over the last few years, the public performance of songs authored before sound recordings fell under federal copyright law and has become a intense legal issue, but on Tuesday (5/31), a California judge handed down a ruling that could help immunize terrestrial radio operators and others from lawsuits and change many preconceived notions about copyright law.

The decision from U.S. District Court Judge Percy Anderson involves a dispute between ABS Entertainment and CBS Radio, which was brought to court after others found success litigating the theory that pre-1972 songs are protected under state law and can't be broadcast without permission. On the issue of originality, the judge gave credence to CBS' expert, Dr. Durand Begault, an acoustic engineer and research scientist specializing in forensic investigation of audio evidence, and found that the plaintiffs' pre-1972 sound recordings "have undergone sufficient changes during the remastering process to qualify for federal copyright protection," adding that ABS hasn't offered sufficient evidence to even make this a contestable point for a jury to decide. According to CBS Radio, it was not performing the original analog recordings, once distributed mainly through vinyl, but rather remastered versions that came out after 1972. Under this argument, the specifically performed works aren't protected by state law, and CBS doesn't have to pay. READ ARTICLE HERE

Johnjay Van Es #Loveup Campaign Draws Cover

THE MOUTH, JUNE 2ND, 2016 –– North Valley magazine recently featured Johnjay Van Es of The Johnjay & Rich Show in a cover story highlighting his radio career and how he uses his fame to benefit others. The article details how a simple hashtag created by Johnjay – #LoveUp – grew into a fundraising vehicle for those less fortunate.

As for #LoveUp, Johnjay actually stumbled upon this “campaign” via text with football legend Kurt Warner. Warner coaches Van Es’ son’s football team, and one day Kurt was unable to make it to a game. In his absence, Van Es kept Warner updated through text, giving him play-by-play details about the game. At one point, the kids made a killer pass, catch, and touchdown, and Van Es texted Warner about the amazing play. In response, Warner texted “Love up;” thanks to auto text, the cell phone altered his intentional message of “Love it.”

Johnjay is joined by co-host Rich Berra and Kyle is syndicated by Premiere Networks and also available on iHeartRadio. READ STORY HERE

[LISTEN] Glenn Beck Spox Responds To Fallout Following Trump Comments; SiriusXM Relationship Status Complicated

7

THE MOUTH, JUNE 1ST, 2016 –– For those of us who live in the Google Alerts world, yesterday's inboxes rained with articles of SiriusXM's decision to suspend Glenn Beck's radio show following comments on presumptive GOP Presidential candidate, Donald Trump. Beck was chatting with thriller writer Brad Thor (shown right) about Trump’s potential presidency and some of their comments were construed by some to have advocated harm against an individual currently running for office

7With Beck on vacation, Dom Theodore, GM, Glenn Beck Radio Show responded to what he called, "unfortunate fabrications surrounding his interview with Brad Thor." As every listener of the show knows, Glenn has never — and will never — advocate violence. It wasn’t long ago that he was criticized by some for advocating peace during the Bundy Ranch saga. Glenn is a firm believer in Martin Luther King’s approach to affecting change, not Malcolm X's. This past summer, he organized an event in Birmingham, Alabama called Restoring Unity, the purpose of which was to unite different groups to commit to come together. Again, Glenn has never advocated violence. His interview with Brad Thor speaks for itself.

7"This viral hatchet job is based on 49 seconds out of a 15-minute interview that gives no context of the hypothetical posited from by Brad Thor, a thriller writer," added Theodore. "Glenn is on the record, repeatedly, expressing concern for all people, especially the President of the United States. With every scandal at the Secret Service, Glenn has implored his audience to pray for the safety of the President and for the restoration of the Secret Service’s judgment and abilities. And to answer the question before it has been asked: No one from any governmental agency, Secret Service, police force, etc., has been in contact with our company about this story in any way, shape, or form." The Glenn Beck Radio Program is distributed by Premiere Networks. "What happens from here is between Premiere and SiriusXM," said Theodore. "We have been told that Glenn will be back on the Patriot Channel on Monday morning. READ MORE HERE -LISTEN TO EXCHANGE HERE

REPORT: Shari Redstone Says Viacom Shareholders Want New Management

THE MOUTH, JUNE 1ST, 2016 –– Shari Redstone, the daughter of media billionaire Sumner Redstone, said Viacom Inc. 7shareholders want new management reports bloomberg.com. Shari Redstone, who is vice chair of Viacom, said in a statement issued Tuesday by a spokeswoman that she has no desire to manage the company or become chairman. Sumner Redstone could call a special meeting of the media company’s stockholders and replace the board, according to billionaire Mario Gabelli, the second-largest owner of Viacom voting shares, but any effort to do so is likely to be challenged in court by Viacom’s board, he said in an interview.

“This is basically legal entanglement,” Gabelli said. Shares of Viacom had fallen 40 percent over the past year before rallying in recent days as Redstone began to reassert his control over the company, the owner of Comedy Central, Nickelodeon and Paramount Pictures.
